Welcome to OneDevCloud. These Terms of Service govern your access to and use of our website, hosting services, domain services, email services, servers, cloud infrastructure, support services, and any related products or features provided by OneDevCloud.
By creating an account, placing an order, accessing our website, or using our services, you agree to be bound by these Terms of Service. If you do not agree with these terms, you must not use our services.
Definitions
In these Terms, “we,” “us,” and “our” refer to OneDevCloud. “You,” “your,” “customer,” or “user” refers to the person or organization using our services. “Services” means any hosting, domain, email, cloud, server, website, technical support, or related service provided through OneDevCloud.
Eligibility
You must be legally capable of entering into a binding agreement in your jurisdiction. If you are using our services on behalf of a business or organization, you confirm that you have authority to accept these Terms on its behalf.
Account Registration and Security
You agree to provide accurate, complete, and current account information. You are responsible for maintaining the confidentiality of your login details, passwords, billing account, and any activity that occurs under your account.
You must notify us immediately if you suspect unauthorized access, misuse, or a security issue involving your account or hosted services.
Services Provided
OneDevCloud may provide services including, but not limited to:
- Shared web hosting
- Cloud hosting
- VPS or dedicated server services
- Domain registration and management
- SSL certificate services
- Email hosting
- Website migration assistance
- Technical support and server management
- Backup, security, and monitoring services
Orders, Activation, and Service Delivery
Services are activated after successful payment, fraud review, and verification where required. Some services may require manual approval before activation.
We reserve the right to reject, suspend, or cancel any order that appears fraudulent, abusive, high-risk, inaccurate, or in violation of these Terms.
Billing and Payments
You agree to pay all fees associated with your selected services, billing cycle, add-ons, renewals, upgrades, and applicable taxes. Prices may vary depending on the selected plan, service term, currency, location, promotions, or third-party provider costs.
Invoices must be paid by the due date shown in your account. Failure to pay may result in suspension, termination, late fees, data loss, or cancellation of services.
Renewals
Services may renew automatically or require manual renewal depending on your account settings and payment method. You are responsible for ensuring that your billing details remain valid and that renewal invoices are paid on time.
Domain names, SSL certificates, licenses, and third-party services may have strict renewal deadlines. We are not responsible for loss of a domain, certificate, license, website, email, or service caused by late or failed payment.
Refund Policy
Refund eligibility depends on the type of service purchased. Hosting services may be eligible for a refund within 3 days of the first purchase, unless otherwise stated on the product page.
The following services are generally non-refundable once registered, activated, provisioned, or delivered:
- Domain name registrations, renewals, and transfers
- SSL certificates
- Software licenses
- Dedicated servers
- VPS servers after provisioning
- Setup fees
- Migration fees
- Custom development or custom configuration services
- Third-party products or services
Refunds may be refused if the service was used for abuse, spam, fraud, policy violations, chargeback abuse, or activities prohibited by these Terms.
Acceptable Use Policy
You agree to use our services lawfully, responsibly, and in a way that does not harm our network, infrastructure, reputation, other customers, or third parties.
You must not use our services for:
- Spam, unsolicited bulk email, or email abuse
- Phishing, fraud, impersonation, credential theft, or deceptive activity
- Malware, viruses, botnets, ransomware, or harmful code
- Network attacks, port scanning, denial-of-service activity, or unauthorized access
- Hosting or distributing illegal, abusive, exploitative, hateful, or harmful content
- Copyright, trademark, or intellectual property infringement
- Resource abuse, excessive CPU usage, excessive memory usage, or activities that degrade service quality for other users
- Cryptocurrency mining unless expressly permitted in writing
- Proxy, VPN, scraping, or automation services that violate laws, third-party terms, or network rules
- Any activity that violates applicable laws, regulations, or third-party rights
Resource Usage
Hosting plans may include resource limits such as CPU, memory, storage, bandwidth, inode usage, database usage, email sending limits, processes, or account activity. Unlimited or unmetered services are subject to fair use and must not be used in a way that harms server performance or other customers.
We may request that you optimize, upgrade, reduce, or remove resource-heavy content, scripts, accounts, or applications. We may suspend or limit services if usage threatens server stability, security, or network performance.
Backups and Data Responsibility
You are responsible for maintaining your own independent backups of your websites, files, databases, emails, applications, and account data.
We may provide backup services as a courtesy or paid feature, but we do not guarantee that any backup will be available, complete, current, restorable, or free from error unless expressly stated in a separate written agreement.
Domain Names
Domain registration, renewal, transfer, and management are subject to registry rules, registrar policies, availability, payment status, and applicable laws.
You are responsible for keeping domain contact information accurate and for renewing domains before expiration. We are not liable for domain expiration, deletion, redemption fees, loss, suspension, or transfer failure caused by inaccurate details, late payment, registry action, or customer inaction.
Email Services
Email services must be used responsibly and must not be used for spam, phishing, abusive messaging, unauthorized mailing lists, or deceptive communications.
We may apply email limits, filtering, rate controls, spam protection, or suspension where necessary to protect service quality, deliverability, and network reputation.
Security
You are responsible for securing your websites, applications, scripts, passwords, plugins, themes, permissions, and account access. You must keep all software updated and remove vulnerable or unsupported applications.
We may suspend, isolate, or restrict services if we detect malware, compromised files, abusive activity, suspicious behavior, or risks to our infrastructure or other customers.
Support
We provide support through the channels listed on our website or client area. Support availability and scope may vary by service plan.
Support may include assistance with hosting-related issues, server availability, basic configuration, billing, and service access. Support does not normally include custom coding, third-party software development, website design, SEO, advanced debugging, or repair of customer-created errors unless specifically included in your plan.
Service Availability
We work to provide reliable service; however, no hosting, cloud, internet, or network service can be guaranteed to be uninterrupted, error-free, or completely secure.
Downtime may occur due to maintenance, upgrades, hardware failure, software issues, security events, network problems, third-party providers, force majeure events, or circumstances beyond our reasonable control.
Maintenance
We may perform scheduled or emergency maintenance to improve security, performance, reliability, or service quality. When practical, we may provide notice of scheduled maintenance, but emergency maintenance may occur without prior notice.
Suspension and Termination
We may suspend or terminate services immediately if:
- You fail to pay invoices on time
- You violate these Terms or our policies
- Your account is involved in abuse, fraud, spam, malware, or security incidents
- Your usage threatens our infrastructure or other customers
- Required verification is not completed
- We are required to do so by law, registry, court order, payment processor, or provider
Suspension or termination does not remove your obligation to pay outstanding fees.
Customer Content
You retain ownership of the content you upload, host, send, or store using our services. You grant us a limited right to process, store, transmit, back up, and display your content only as needed to provide and support the services.
You are solely responsible for your content and for ensuring that it complies with applicable laws, these Terms, and third-party rights.
Intellectual Property
All trademarks, logos, website content, software, designs, documentation, and materials provided by OneDevCloud remain the property of OneDevCloud or its licensors.
You may not copy, reverse engineer, resell, modify, or misuse our intellectual property except as expressly allowed in writing.
Third-Party Services
Some services may depend on third-party providers such as registrars, data centers, control panels, SSL providers, payment processors, software vendors, email filtering providers, or cloud infrastructure providers.
We are not responsible for third-party outages, policy changes, price changes, service limitations, or failures outside our reasonable control.
Limitation of Liability
To the maximum extent permitted by law, OneDevCloud will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, business, goodwill, or service availability.
Our total liability for any claim related to the services is limited to the amount you paid for the affected service during the one month immediately before the event giving rise to the claim.
No Warranty
Services are provided on an “as is” and “as available” basis. We do not guarantee that services will be uninterrupted, error-free, completely secure, compatible with every application, or suitable for every business purpose.
Indemnification
You agree to defend, indemnify, and hold harmless OneDevCloud, its owners, employees, contractors, providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the services, your content, your violation of these Terms, or your violation of any law or third-party right.
Changes to These Terms
We may update these Terms from time to time. Updated terms will be posted on our website with a revised “Last Updated” date. Continued use of the services after changes become effective means you accept the updated Terms.
Governing Law
These Terms are governed by the laws of the United States, unless another governing law is required by applicable consumer protection law.
